“Running out of fuel on the German Autobahn is illegal”
TRUE! There is no specific "fuel law" - but stopping unnecessarily on the Autobahn is illegal. Running out of fuel is considered a "preventable circumstance" and therefore not excusable.
On sections of the Autobahn with no speed limit, traffic can be moving at 200+ km/h. A stationary vehicle is extremely dangerous. Breakdowns due to mechanical failure are excused; running out of fuel is not, because you had a working fuel gauge. What happens if you run out of fuel: 1. Pull as far right as possible onto the shoulder 2. Put on your high-visibility vest (mandatory in German vehicles) 3. Set up warning triangle 200m behind vehicle 4. Walk to nearest emergency phone (blue posts along Autobahn) 5. Wait for roadside assistance 6. Receive a fine Bonus Weirdness: It's also illegal to WALK on the Autobahn - so if you do run out of fuel and try to walk to a petrol station, that's a second offense.
Where the story gets it wrong
People often think there's a specific law mentioning fuel. In reality, running out of fuel falls under the general duty in StVO §23 requiring drivers to ensure their vehicle is in proper operating condition. It is treated as a preventable failure, unlike a genuine mechanical breakdown, which may be excused.
StVO §23 Abs. 1: "Wer ein Fahrzeug führt, ist dafür verantwortlich, dass seine Sicht und das Gehör nicht durch die Besetzung, Tiere, die Ladung, Geräte oder den Zustand des Fahrzeugs beeinträchtigt werden. Wer ein Fahrzeug führt, hat zudem dafür zu sorgen, dass das Fahrzeug, der Zug, das Gespann sowie die Ladung und die Besetzung vorschriftsmäßig sind und dass die Verkehrssicherheit des Fahrzeugs durch die Ladung oder die Besetzung nicht leidet."
