As urban beekeeping has gained popularity (for pollination, honey production, and environmental consciousness), municipalities have had to develop frameworks balancing hobbyist enthusiasm with neighbor concerns. Oak Bay's approach is notably detailed. The bylaw doesn't simply allow or ban beekeeping—it requires a formal permit application, a site plan showing exact hive locations, compliance with minimum distance requirements from property lines, and consideration of flight paths and neighboring properties. Victoria Animal Control Services enforces Oak Bay's animal bylaws, creating regional consistency in enforcement.
Where the story gets it wrong
This is not an outright ban on beekeeping - Oak Bay permits it, but with unusually detailed requirements compared to most municipalities. Residents can keep up to 2 hives on parcels of 930 m² or less, or 4 hives on larger parcels. The setback is 1.5 metres from any parcel boundary, reduced from 6 metres by Bylaw 4591 in 2013 - not by the 2023 amendment, as some summaries claim. The entrance-height rule still applies: under s. 30.1(6) a hive entrance must sit at least 2.4 metres above ground level, or else behind solid fencing at least 2.0 metres high. Bylaw 4840 (July 2023) repealed the rear-yard placement rule (s. 30.1(5)) and the fencing exception (s. 30.2), and moved zoning eligibility into the Zoning Bylaw.
No person shall keep, house or confine bees within the Municipality without first applying for and obtaining a beekeeping permit from the Licence Inspector. [s. 29] Without derogating from any requirement imposed by a bylaw regulating the application and permit process for the constructions of buildings or other structures, an application for a beekeeping permit shall include: (1) a scaled and dimensioned site plan showing the proposed location of each beehive and its distance from the boundaries of the parcel; and (2) a scaled and dimensioned elevation plan showing the height of the entrance to each beehive [s. 30] On application, the Licence Inspector shall issue a beekeeping permit where the application complies with the following conditions: ... (3) the number of beehives proposed to be erected, placed or constructed does not exceed: (a) two (2) for a parcel of area less than or equal to 930 square metres; nor (b) four (4) for a parcel of area greater than 930 square metres; (4) no beehive is located closer than 1.5 metres to any boundary of the parcel [s. 30.1] — Oak Bay Animal Control Bylaw, 1999 (Bylaw No. 4013), ss. 29-30.1, as amended by Bylaw 4840 (2023)
