Oak Bay requires permits, site plans, and distance calculations for backyard beekeeping

Categories:Animals & Pets

The Short Answer

ACTIVE! Anyone wishing to keep bees in Oak Bay must obtain a permit, submit a site plan showing hive placement, and ensure hives are positioned at specified distances from property lines and neighboring residences.

The Full Story

As urban beekeeping has gained popularity (for pollination, honey production, and environmental consciousness), municipalities have had to develop frameworks balancing hobbyist enthusiasm with neighbor concerns.

Oak Bay's approach is notably detailed. The bylaw doesn't simply allow or ban beekeeping—it requires:

  • A formal permit application
  • A site plan showing exact hive locations
  • Compliance with minimum distance requirements from property lines
  • Consideration of flight paths and neighboring properties

This regulatory approach reflects Oak Bay's character as an established residential community where neighbor relations and property values are prioritized. The permit system ensures the municipality can track beekeepers and respond to complaints.

Victoria Animal Control Services enforces Oak Bay's animal bylaws, creating regional consistency in enforcement.

Common Misconceptions

This is not an outright ban on beekeeping — Oak Bay permits it, but with unusually detailed bureaucratic requirements compared to most municipalities. The site plan and distance calculations exist to protect neighbors from bee flight paths. Residents can keep up to 2 hives on properties under 930 m² or 4 hives on larger lots, and hive entrances must either be 2.4 metres high or screened by a 2-metre solid fence.

Actual Legal Text

No person shall keep, house or confine bees within the Municipality without first applying for and obtaining a beekeeping permit from the Licence Inspector. An application for a beekeeping permit shall include: a scaled and dimensioned site plan showing the proposed location of each beehive and its distance from the boundaries of the parcel; and a scaled and dimensioned elevation plan showing the height of the entrance to each beehive. Hives must be located a minimum of 6 metres from any property boundary and placed in the rear yard only. — Oak Bay Bylaw No. 4013 (as amended by Bylaw 4417)
